Terms of Service – P2Drive

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of P2Drive (“Service,” “we,” “our,” or “us”), operated by Gergedan LLC, registered in the State of New Mexico, USA.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By using the Service, you confirm that you meet this requirement.

3. Description of Service

P2Drive provides tools for content creators to back up their digital content (including Patreon content) to cloud storage providers such as Google Drive.
We do not sell content or act as a payment processor.
We are not affiliated with Google, Patreon, or any other third-party platform.

4. Account Registration

• To use certain features, you may be required to create an account.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any law.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any systems or networks.
• Upload or store content that infringes intellectual property rights or contains unlawful material.

6. Third-Party Integrations

Our Service may integrate with third-party services such as Google Drive and Patreon:

• Use of these integrations requires your explicit authorization.
• Their services are subject to their own terms and privacy policies.
• We are not responsible for downtime, errors, or changes in their platforms.

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by Gergedan LLC and is protected by intellectual property laws.
You retain ownership of the content you upload or back up via the Service.

8. Termination

We may suspend or terminate your account if you violate these Terms or if required by law.
You may close your account at any time; upon closure, we will delete your stored data within a reasonable period, except where retention is required by law.

9. Disclaimers

The Service is provided on an “as-is” and “as-available” basis without warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free operation of the Service.

10. Limitation of Liability

To the maximum extent permitted by law:

• Gergedan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims arising from your use of the Service will not exceed the amount you paid to us in the last 12 months.

11. Indemnification

You agree to indemnify and hold harmless Gergedan LLC and its affiliates from and against any claims, damages, or expenses arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your infringement of any third-party rights.

12. Changes to Terms

We may update these Terms from time to time. The updated version will be effective as of the “Effective Date” above. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles.
